Goa foundation & Goa Bachao Abhiyan earlier this week has challenged insertion of sections 16B into the Goa Town and Country Planning Act 1974. The Bombay high court at Goa, has sought a reply from the state govt & TCP board over the Public Interest litigation filed by the 2 NGO’s.
According to recently, amended TCP Act – Section 16B, allows individuals to convert orchard land to settlement zones & Settlement Areas to Industrial development zones by paying prescribed fees.
NGO’s in its petition before the high court, have stated that the provisions vest arbitrary, unguided and absolute powers to the TCP for land zone conversion. The petitioner has also pleaded to the court that purpose of the planned development in Goa would be defeated due to the recent amendments to the TCP Act.
