According to Goa Foundation, the division bench of the Bombay high court in Goa comprising of Justice C.V. Bhadang and Nutan Sardessai has issued notice on 23rd August seeking demolition of the resort Grand Hyatt at Bambolim to Union Ministry of Environment & Forests, Goa Coastal Zone Management Authority, TCP Dept, Goa chief secretary, Goan Real Estate and Construction Ltd., Goan Hotels & Clubs Pvt. Ltd.
The petition has been filed in public interest for recovery of a public beach at Bambolim, occupied illegally by the Hotel Grand Hyaat Goa.
Two earlier petitions filed by the Goa Foundation challenging the legality of the constructions occupied by the said resort were dealt with by judgements dated 26.2.2014 and 20.1.2015. These judgements held that the plans which the Respondents were relying upon for the legality of the constructions made were invalid. The judgements quashed the approvals granted.
The Goa Foundation petition prays that the Hon’ble Court will restrain the Respondent hotel and the Grand Hyatt from any further use and exploitation of the premises for purposes of a luxury resort. It also seeks directions to both the Town Planning and the Village Panchayat to demolish the constructions which fall between 50 to 100 metre zone from the HTL. Notice is returnable in six weeks.
