Sighting that the Vedanta resources plant at Surla & Amona And Fomento’s at Cuddegal are illegally carrying operations without environmental clearances, The National Green Tribunal in Pune last week has directed the Indian Ministry of Environment, Forest and Climate change and Goa Pollution Control Board to take remedial action in accordance with this finding to enforce the rule of law”.
According to orders issued by the westerns bench of the National Green Tribunal, “As per entry 2(b) of Schedule to the EIA Notification, 2006 Mineral Beneficiation along with two (2) categories ‘A’ & ‘B with threshold limits of ≥ 0.1million ton/annum mineral throughput & < 0.1 million ton/annum mineral throughput respectively and a general condition that mining proposal with Mineral Beneficiation shall be appraised together for grant of clearance. Thus, the plant in question cannot operate without requisite EC”.
NGT further said that “As already mentioned, the affidavit of the GSPCB clearly shows that the plants though initially started in 1997, the same were reconstructed and shifted in 2012 even though capacity remained the same and they were renamed. No objection was raised at that time nor such objection is now being raised on account of expiry of time for the past functioning but objection is that on recommencement in 2019, EC must be obtained and the plant cannot continue without the same. We, thus, find that recommencement of the plant in the year 2019 can only be after obtaining EC at a site which is different from the site where the plant was set up at a time when there was no requirement of EC i.e. in the year 1997”.
